Laws regulating static, electric, shock and electronic correction collars differ between Australian states and territories. The legal position may depend on the customer’s location, the specific product, the product’s features, whether the product is capable of delivering static or electric correction, and the intended use of the product.


In some jurisdictions, it may be unlawful to purchase, possess, sell, supply, ship, or use these products. In other jurisdictions, use may only be permitted in limited circumstances or subject to strict animal welfare, product, training, record-keeping or information requirements.


Before purchasing any static, electric, or shock correction product, you must check the current laws that apply in your state or territory. By purchasing this product, you confirm that you have reviewed the current applicable laws in your location and in any location where the product may be shipped, possessed or used, and that your purchase, possession, receipt, supply, and intended use of the product are lawful.
4Paws Australia does not encourage, recommend, or condone the use of any product in a way that is unlawful, unsafe, inhumane, excessive, or contrary to animal welfare laws.

All products must be used only in accordance with manufacturer instructions, applicable laws, and accepted animal welfare standards.


Subject to any non-excludable rights or guarantees under the Australian Consumer Law, 4Paws Australia reserves the right to refuse, cancel, or refund any order, before or after acceptance of payment, where the product may be unlawful to sell, supply, ship, purchase, possess, or use in the customer’s state or territory or where 4Paws Australia considers that fulfilling the order may create legal, animal welfare, consumer law, or safety risk.

State and Territory Guidance

New South Wales


New South Wales should be treated as a prohibited or high-risk jurisdiction for static, electric, and shock correction collars.


Customers in New South Wales should not purchase, possess, or use these products unless they have confirmed that a specific lawful exception applies. In particular, any exception for electric boundary systems should be treated narrowly and should not be understood as permitting general remote training collars.

4Paws Australia will refuse, cancel, or refund orders for static, electric, or shock correction collars where the billing, shipping, or delivery address is in New South Wales, unless 4Paws Australia has confirmed that a specific lawful exception applies, and may refuse, cancel, or refund any order where 4Paws Australia otherwise considers that the product may be purchased, possessed, supplied, or used in New South Wales.


Australian Capital Territory


The Australian Capital Territory should be treated as a prohibited or high-risk jurisdiction for static, electric, and shock correction collars.


Customers in the ACT should not purchase, possess, or use products that are capable of administering an electric or static shock to an animal.


4Paws Australia will refuse, cancel, or refund orders for static, electric or shock correction collars where the billing, shipping or delivery address is in the Australian Capital Territory, and may refuse, cancel, or refund any order where 4Paws Australia otherwise considers that the product may be purchased, possessed, supplied, or used in the Australian Capital Territory.

South Australia

South Australia should be treated as a prohibited or high-risk jurisdiction for static, electric, and shock correction collars.


Customers in South Australia should not purchase, possess, or use these products where their intended use is to confine, control, or train an animal by electric or static correction.


4Paws Australia will refuse, cancel, or refund orders for static, electric, or shock correction collars where the billing, shipping, or delivery address is in South Australia, unless 4Paws Australia has confirmed that a specific lawful exception applies, and may refuse, cancel, or refund any order where 4Paws Australia otherwise considers that the product may be purchased, possessed, supplied, or used in South Australia.

Victoria


Victoria should be treated as a restricted jurisdiction.


Electronic collars are not subject to a blanket prohibition in Victoria, but their sale, supply, and use are subject to detailed legal requirements. These may include requirements relating to product design, technical specifications, information provided to purchasers, record-keeping, the animal’s age and health, supervision, training, and compliance with prescribed conditions.


Customers in Victoria must not assume that a static, electric, or shock correction collar is lawful merely because it is available for purchase online. Before purchasing or using any such product, Victorian customers must confirm that the product and intended use comply with Victorian law.


4Paws Australia may refuse, cancel, or refund orders to Victorian customers where product compliance, purchaser information, record-keeping requirements or lawful use has not been confirmed.


Western Australia


Western Australia should be treated as a restricted or cautionary jurisdiction.
Use of electric shock devices may only be permitted in limited circumstances and remains subject to animal welfare laws.

Customers in Western Australia must ensure that the product, the way it is used, and the circumstances of use fall within any permitted exception and do not cause unnecessary harm, pain, distress, or suffering.


Static, electric, and shock correction collars should not be treated as generally or unrestrictedly lawful in Western Australia, and 4Paws Australia may refuse, cancel, or refund orders where it is not satisfied that the product and proposed use fall within a permitted exception.


Northern Territory


The Northern Territory should be treated as a restricted or high-risk jurisdiction, particularly for remote-controlled static or shock collars.


Some electric training collars may fall within excluded categories under Northern Territory laws, but remote-controlled shock/static collars should be treated as prohibited or high risk.


Customers in the Northern Territory must confirm that the specific product they wish to purchase, possess, or use is lawful and that their intended use complies with Northern Territory animal welfare laws.


4Paws Australia may refuse, cancel, or refund orders for remote-controlled static or shock correction collars where the billing, shipping, or delivery address is in the Northern Territory, or where 4Paws Australia otherwise considers that the product may be purchased, possessed, supplied, or used in the Northern Territory contrary to applicable law.


Queensland


Queensland is not currently treated as a prohibited jurisdiction for static, electric, or shock correction collars in ordinary private dog-training contexts. However, customers remain subject to general animal welfare laws, and 4Paws Australia may refuse, cancel, or refund orders where it considers that supply or intended use may be unlawful, unsafe or inappropriate.


Customers in Queensland must use any product safely, humanely, and lawfully, and must not use any product in a way that causes unjustifiable, unnecessary, or unreasonable pain, suffering, injury, or distress to an animal.
Static, electric and shock correction collars should not be described as risk-free or unrestrictedly lawful in Queensland.


Tasmania


Tasmania is not currently treated as a prohibited jurisdiction for static, electric, or shock correction collars in ordinary private dog-training contexts. However, customers remain subject to general animal welfare laws, and 4Paws Australia may refuse, cancel, or refund orders where it considers that supply or intended use may be unlawful, unsafe or inappropriate.


Customers in Tasmania must not use any product in a way that causes, or is likely to cause, unreasonable or unjustifiable pain or suffering to an animal.
Static, electric, and shock correction collars should not be described as risk-free or unrestrictedly lawful in Tasmania.


Customer Acknowledgement


By purchasing a static, electric, shock, or electronic correction collar from 4Paws Australia, you acknowledge and agree that:

1. You have checked the laws that apply in your state or territory;


2. Your purchase, receipt, possession, supply, and intended use of the product are lawful in each location where the product will be shipped, possessed, or used;


3.you will use the product only in accordance with manufacturer instructions and applicable animal welfare laws;


4.you will not use the product in any way that causes unnecessary pain, harm, distress, or suffering to an animal;


5.you understand that laws may change, that enforcement practices may vary, and that this information is general only and may not identify every legal restriction or exception that applies to you;

6.you have obtained independent advice or contacted your local animal welfare authority if you are unsure whether the product is lawful in your location; and


7. 4Paws Australia may refuse, cancel, or refund your order if it considers that the sale, supply, shipping, purchase, possession, or intended use of the product may be unlawful, unsafe, inhumane, or otherwise inappropriate.


To the maximum extent permitted by law, 4Paws Australia is not liable for loss, damage, injury, penalty, claim, or other consequence arising from unlawful purchase, possession, supply, shipping, or use of these products, or from misuse of any product contrary to law, manufacturer instructions or animal welfare standards, and nothing in this notice excludes, restricts or modifies any non-excludable rights or guarantees under the Australian Consumer Law.
